Sheep production is the most representative livestock activities in Brazil and in the world. However, the reproductive performance of these animals is determined by factors genetic, physical environment, management and, especially, nutritional. Thirty half-breed lambs from Dorper × Santa Inês were used, with initial weight and age of 31.87 ± 0.5 kg and 157 days, respectively. These animals were prepared on a diet with three food levels (ad libitum, 30% and 70%). Morphometric measurements were measured at intervals of 16 to (...) 20 days in 56 experimental days. The measurements performed were scrotal circumference (CE), chest circumference (CT), body condition score (ECC), withers height (AC) and scrotal bag thickness (EBE), body weight (CP) and semen collection. Interaction occurrence for biometric measurements between food levels and age (p <0.05). The TC and ECC values were higher in animals fed ad libitum (p <0.001). EBE had higher values in animals ad libitum and at 211 days of age (p <0.001). The CP was increasing for the animals ad libitum and (p <0.05) throughout the experiment, while the T30 was only in the initial period. T70 animals did not grow during the whole experiment. CE was influenced by diet (p <0.001) and age (p <0.001) independently. So that animals under food restriction had less development and was higher in older animals. The AC values were influenced only by age (p <0.001), demonstrating the effect of age growth. We conclude that it is not advantageous to submit lambs, it corrects food reproduction. Departing from Anderson’s (2016) suggestion that there are three communities in Peirce’s thought corresponding to his three normative sciences of logic, ethics, and esthetics, I argue that these communities partake in a relationship of dependence similar to that found among the normative sciences. In this way, just as logic relies on ethics which relies on esthetics, so too would a logical community of inquirers rely on an ethical community of love, which would rely on an esthetic community of artists. A (...) community could conduct inquiry together only if it pursued the same goal; and it could pursue the same goal only if it first imaginatively construed it. Any logical or ethical community requires a shared imaginative repertoire of ideal ends. (shrink)

Law-enforcement agencies are increasingly able to leverage crime statistics to make risk predictions for particular individuals, employing a form of inference that some condemn as violating the right to be “treated as an individual.” I suggest that the right encodes agents’ entitlement to a fair distribution of the burdens and benefits of the rule of law. Rather than precluding statistical prediction, it requires that citizens be able to anticipate which variables will be used as predictors and act intentionally to avoid (...) them. Furthermore, it condemns reliance on various indexes of distributive injustice, or unchosen properties, as evidence of law-breaking. (shrink)

The problem of moral disagreement has been presented as an objection to contextualist semantics for ‘ought’, since it is not clear that contextualism can accommodate or give a convincing gloss of such disagreement. I argue that independently of our semantics, disagreements over ‘ought’ in non-cooperative contexts are best understood as indirect metalinguistic disputes, which is easily accommodated by contextualism. If this is correct, then rather than posing a problem for contextualism, the data from moral disagreements provides some reason to adopt (...) a semantics that allows contextual variance in the meanings of ‘ought’. In this paper I argue that, to conceive transcendence, Levinas retrieves the Platonic concept of “separation” and deploys it in three ways: metaphysically, semantically, and affectively. Levinas finds in the interaction between being and the Good beyond being of Republic VI 509b a certain “formal structure of transcendence”—one in which a term is conditioned by another while remaining absolutely separated from it. This formal structure is subsequently deployed metaphysically, in the relation between creator and creature; semantically, in the relation between (...) meaning and sense; and affectively, in the relation between the desiring self and its desired aim. In addition to protecting agents’ autonomy, consent plays a crucial social role: it enables agents to secure partners in valuable interactions that would be prohibitively morally risk otherwise. To do this, consent must be observable: agents must be able to track the facts about whether they have received a consent-based permission. I argue that this morally justifies a consent-practice on which communicating that one consents is sufficient for consent, but also generates robust constraints on what sorts of behaviors can be (...) taken as consent- communicating. In this essay I will defend three points, the first being that Descartes- unlike the aristotelian traditon- maintained that abstraction is not a operation in which the intellect builds the mathematical object resorting to sensible ob- jects. Secondly I will demonstrate that, according to cartesian philosophy, the faculty of understanding has the ability to instatiate- within the process of abstraction- mathematical symbols that represent the relation between quantities, whether magnitude or multitude.And finally I will advocate that the lack of onthological (...) commitment with sensible experience found in cartesian philosophy of mathematics allows for the creation of a mathematical language that regards the objects of geometry and arithmetics through a system of rules and notations, in other words, algebra. In this paper, I argue that Plotinus does not limit the sphere of free human agency simply to intellectual contemplation, but rather extends it all the way to human praxis. Plotinus’s goal in the first six chapters of Ennead 6.8 is, accordingly, to demarcate the space of freedom within human practical actions. He ultimately concludes that our external actions are free whenever they actualize, in unhindered fashion, the moral principles derived from intellectual contemplation. This raises the question of how the (...) freedom of practical actions might relate to the freedom of intellectual contemplation. After considering two previously offered models—a model of double activity, and an Aristotelian model of practical syllogism—I offer a third alternative, namely a model of moral attunement, according to which our rational desires assume a kind of ‘care of the soul’ through active supervision. Practical life is thus imbued with freedom to the extent that the soul supervises its actions to conform to its will and choice of the good. (shrink)

​I evaluate a suggestion, floated by Kimberly Ferzan (this volume), that the twitter hashtag campaign #BelieveWomen is best accommodated by non-reductionist views of testimonial justification. I argue that the issue is ultimately one about the ethical obligation to trust women, rather than a question of what grounds testimonial justification. I also suggest that the hashtag campaign does not simply assert that ‘we should trust women’, but also militates against a pernicious striking-property generic (roughly: ‘women make false sexual assault accusations’), that (...) distorts our evaluation of women’s testimony concerning sexual assault. I conclude #BelieveWomen does not demand that we believe against the evidence, or uncritically, or be more trusting than we have evidential justification to be. Rather, it aims to bring our trust closer to what is merited by the base-rate of reliable testimony from women concerning sexual assault. (shrink)

We reflect on a decade of Responsible Research and Innovation (RRI) as a discourse emerging from the European Commission (EC) 10 years ago. We discuss the foundations for RRI, its emergence during the Seventh Framework programme and its subsequent evolution during Horizon 2020. We discuss how an original vision for RRI became framed around five so-called ‘keys’: gender, open access, science communication, ethics and public engagement. We consider the prospects for RRI within the context of the EC’s Open Science agenda (...) and Horizon Europe programme, before closing with some reflections on the contribution RRI has made to debates concerning the relationship between science, innovation and society over the last decade. For Aristotle, demonstrative knowledge is the result of what he calls ‘intellectual learning’, a process in which the knowledge of a conclusion depends on previous knowledge of the premises. Since demonstrations are ultimately based on indemonstrable principles (the knowledge of which is called ‘νοῦς’), Aristotle is often described as advancing a foundationalist doctrine. Without disputing the nomenclature, I shall attempt to show that Aristotle’s ‘foundationalism’ should not be taken as a rationalist theory of epistemic justification, as if the first principles (...) of science could be known as such independently of their explanatory connections to demonstrable propositions. I shall argue that knowing first principles as such involves knowing them as explanatory of other scientific propositions. I shall then explain in which way noetic and demonstrative knowledge are in a sense interdependent cognitive states – even though νοῦς remains distinct from (and, in Aristotle’s words, more ‘accurate’ than) demonstrative knowledge. I argue that the offense generation pattern of slurring terms parallels that of impoliteness behaviors, and is best explained by appeal to similar purely pragmatic mechanisms. In choosing to use a slurring term rather than its neutral counterpart, the speaker signals that she endorses the term. Such an endorsement warrants offense, and consequently slurs generate offense whenever a speaker's use demonstrates a contrastive preference for the slurring term. Since this explanation comes at low theoretical cost and imposes few constraints on (...) an account of the semantics of slurs, this suggests that we should not require semantic accounts to provide an independent explanation of the offense profile. Some, but not all, of the mistakes a person makes when acting in apparently necessary self-defense are reasonable: we take them not to violate the rights of the apparent aggressor. I argue that this is explained by duties grounded in agents' entitlements to a fair distribution of the risk of suffering unjust harm. I suggest that the content of these duties is filled in by a social signaling norm, and offer some moral constraints on the form such a norm can (...) take. (shrink)

Recently, an increasing number of scholars have been showing interest in old-fashioned racism again. While recent studies on old-fashioned racism apparently increase our knowledge of this psychological theory of racism, the studies actually shed light on a different type of racism, namely offensive racism. The aim of this text is to argue that psychological theories of racism, like old-fashioned racism and modern racism, depend on societies’ social norms. I will show that questionnaires are highly sensitive to social norms, and if (...) there is change in social norms, the original measurement object alters. The theory of old-fashioned racism implicitly assumes agents that follow (or conform to) the social norm to behave prejudiced. Today, however, this social norm does not exist in Western societies. If agents express the same prejudices today, they indicate their willingness to breach the social norm to behave unprejudiced. Thereby, classic old-fashioned racism measures reflect a new kind of racism today. (shrink)

Sometimes speakers within a linguistic community use a term that they do not conceptualize as a slur, but which other members of that community do. Sometimes these speakers are ignorant or naïve, but not always. This article explores a puzzle raised when some speakers stubbornly maintain that a contested term t is not derogatory. Because the semantic content of a term depends on the language, to say that their use of t is semantically derogatory despite their claims and intentions, we (...) must individuate languages in a way that counts them as speaking our language L, assigns t a determinately derogatory content in L, and still accommodates the other features of slurs’ linguistic profile. Given the difficulty of doing this, there is some reason to give a non-semantic analysis of the derogatory aspect of slurs. The author suggests that rather than dismissing the stubborn as semantically incompetent, we would do better to appeal to expected uptake as moral reasons for the stubborn to adjust their linguistic practices. In some cases, there appears to be an asymmetry in the evidential value of statistical and more individualized evidence. For example, while I may accept that Alex is guilty based on eyewitness testimony that is 80% likely to be accurate, it does not seem permissible to do so based on the fact that 80% of a group that Alex is a member of are guilty. In this paper I suggest that rather than reflecting a deep defect in statistical evidence, this (...) asymmetry might arise from a general constraint on rational inquiry. Plausibly the degree of evidential support needed to justify taking a proposition to be true depends on the stakes of error. While relying on statistical evidence plausibly raises the stakes by introducing new kinds of risk to members of the reference class, paradigmatically `individualized' evidence---evidence tracing back to A's voluntary behavior---can lower the stakes. The net result explains the apparent evidential asymmetry without positing a deep difference in the brute justificatory power of different types of evidence. (shrink)

A popular informal argument suggests that statistics about the preponderance of criminal involvement among particular demographic groups partially justify others in making defensive mistakes against members of the group. One could worry that evidence-relative accounts of moral rights vindicate this argument. After constructing the strongest form of this objection, I offer several replies: most demographic statistics face an unmet challenge from reference class problems, even those that meet it fail to ground non-negligible conditional probabilities, even if they did, they introduce (...) new costs likely to cancel out any justificatory contribution of the statistic, but even if they didn’t, demographic facts are the wrong sort to make a moral difference to agents’ negative rights. I conclude that the popular argument should be rejected, and evidence-relative theories do not have the worrisome implication. (shrink)

It is often assumed that trolling is an intentional action. The aim of the paper is to argue for a form of unintentional trolling. Firstly, we outline minimal conditions for intentional actions. Secondly, an unintentional trolling example is introduced. Thirdly, we will show that in some cases, an utterance can be expressive, while it is perceived as descriptive. On the basis of the justification-suppression model, we argue that the introduced trolling example is such a case. In order to bypass social (...) sanctions for expressing prejudices, agents unintentionally express their prejudices through stories that appear to be descriptive. Thereby, the characterized behavior does not fulfill the minimal conditions for intentional action. Fourthly, we give criteria that can be used to identify unintentional trolls. Finally, after unintentional trolling is analyzed, the trolls’ behavioral goals are considered. In conclusion, an analysis of unintentional trolling is given, which has explanatory benefits in contrast to the classic intentional trolling concepts. (shrink)

A ‘vestigial social practice' is a norm, convention, or social behavior that persists even when few endorse it or its original justifying rationale. Begby (2021) explores social explanations for the persistence of prejudice, arguing that even if we all privately disavow a stereotype, we might nevertheless continue acting as if it is true because we believe that others expect us to. Meanwhile the persistence of the practice provides something like implicit testimonial evidence for the prejudice that would justify it, making (...) it rational for members of the next generation to acquire the corresponding prejudiced beliefs. This paper distinguishes between three different types of vestigial social practice in terms of the underlying explanatory mechanisms, and argues that the persistence of prejudicial social stereotypes is most tightly linked not to others’ beliefs or expectations, but to the ways that material infrastructure constrains options shapes social outcomes. Given that, the persistence of a practice only provides grounds to infer that most people endorse the corresponding prejudiced belief only if we are in a position to dismiss relevant alternative explanations. A type of argument occasionally made in metaethics, epistemology and philosophy of science notes that most ordinary uses of some expression fail to satisfy the strictest interpretation of the expression, and concludes that the ordinary assertions are false. This requires there to be a presumption in favour of a strict interpretation of expressions that admit of interpretations at different levels of strictness. We argue that this presumption is unmotivated, and thus the arguments fail.

Richard Wollheim famously argued that figurative pictures depict their scenes, in part, in virtue of their ability to elicit a unique type of visual experience in their viewers, which he called seeing-in. According to Wollheim, experiences of seeing-in are necessarily twofold, that is, they involve two aspects of visual awareness: when a viewer sees a scene in a picture, she is simultaneously aware of certain visible features of the picture surface, the picture’s design, and the scene depicted by the picture. (...) Even though Wollheim’s notion of twofoldness has been very influential, a number of philosophers have put forward powerful arguments against it. In this paper, I defend the claim that some pictorial experiences are twofold in Wollheim’s sense. My argument has two parts. In the first part, I provide a phenomenal contrast argument in favor of twofoldness. In the second part, I respond to what I take to be the most important objections against twofoldness. I believe that both parts together provide strong support for the claim that some pictorial experiences are twofold in Wollheim’s sense. (shrink)

There has been recent discussion of a puzzle posed by emotions that are backward looking. Though our emotions commonly diminish over time, how can they diminish fittingly if they are an accurate appraisal of an event that is situated in the past? Agnes Callard (2017) has offered a solution by providing an account of anger in which anger is both backwards looking and resolvable, yet her account depends upon contrition to explain anger’s fitting diminishment. My aim is to explain how (...) anger can fittingly diminish even when there is lack of contrition. I propose a permissivism about fittingness by showing that both anger and compassion are fitting responses to blameworthy behaviour. I argue that anger is rendered fitting because it accurately appraises the behaviour, whereas compassion becomes fitting as a valuational response to what the behaviour reveals about the lived experience of the offender. I then respond to some worries my account raises, and I clarify details of my account to show that it is not unrealistic to the way some of our anger actually does diminish. I end with a proposal that our anger can fittingly diminish through the act of forgiveness when compassion is not a forthcoming affective response. (shrink)

Martin Seligman y sus colegas, al poner en el centro de la psicología positiva temas como "los motivos de la acción" y "el papel de las emociones", parecen haber desarrollado su propuesta en lo que se puede considerar un cierto vacío teórico dejado por la psicología cognitiva del siglo XX. Ampliando el campo de observación y análisis, surgen nuevas preguntas: ¿Qué ocurre con relación a las principales corrientes de la psicología estadounidense del siglo XX? ¿Dónde se sitúa su propuesta teórica? Este artículo exploratorio se propone caracterizar la psicología positiva desde el punto de vista fundacional y teórico-situándola dentro de la historia de la psicología estadounidense-y busca, a la vez, identificar algunos elementos que pueden contribuir a la eventual relevancia de su aporte teórico a la psicología con-temporánea. Se quiere evidenciar que no se comprende el punto de inflexión que esta puede haber alcanzado dentro de la psicología estadounidense si no se consideran ciertos antecedentes teóricos que precedieron a su nacimiento y el "giro epistemológico" que Seligman y colegas han propuesto a partir de la reintroducción de un telos no metafísico para explicar el dinamismo presente en la acción de los seres humanos y de algunos animales superiores. The ability to solve problems is a prerequisite in preparing mathematics preservice teachers. This study assessed preservice teachers’ problem-solving difficulties and performance, particularly in worded problems on number sense, measurement, geometry, algebra, and probability. Also, academic profile differences in the preservice teacher’s problem-solving performance and common errors were determined. A descriptive-comparative research design was employed with 158 random respondents. Data were gathered face-to-face during the first semester of the school year 2022-2023, and data were analyzed with the aid of jamovi (...) software, ensuring ethical measures. Overall findings revealed that the preservice teachers experienced average difficulty in solving problems. The low performance of the preservice teachers on the given problems was also demonstrated. Further analysis revealed a significant difference between the preservice teachers’ problem-solving performance based on their subject preference and program. Moreover, the error analysis revealed that the preservice teachers incurred comprehension errors in misrepresentation, misinterpretation, and miscalculation. These results will serve as a measure for policymakers and curriculum developers of the teacher education institution concerned to make relevant enhancements to the math courses offered in the elementary and secondary education programs. Esta reconceitualização permite que o amor participe da epistemologia como uma virtude intelectual responsabilista, que nos torna membros mais confiáveis de nossas comunidades epistêmicas e nos aproxima de descrições verdadeiras sobre o mundo, ao deixar que diversos pontos de vista (...) sobre esses objetos sejam reconhecidos e valorizados. Recently, psychologists have developed indirect measurement procedures to predict suicidal behavior. A prominent example is the Death/Suicide Implicit Association Test (DS-IAT). In this paper, I argue that there is something special about the DS-IAT which distinguishes it from different IAT measures. I argue that the DS-IAT does not measure weak or strong associations between the implicit self-concept and the abstract concept of death. In contrast, assuming a goal-system approach, I suggest that sorting death-related to self-related words takes effort because death-related (...) words trigger avoidance-impulses, which suicide ideation weakens. The DS-IAT taps into weakened automatic responses from the self-preservation system. Additionally, the suggested cognitive structure, illuminated with the selfish-goal theory, explains predictable suicidal behavior. (shrink)

This paper surveys some philosophical issues with the language surrounding mental illness, but is especially focused on pejoratives relating to mental illness. I argue that though 'crazy' and similar mental illness-based epithets (MI-epithets) are not best understood as slurs, they do function to isolate, exclude, and marginalize members of the targeted group in ways similar to the harmfulness of slurs more generally. While they do not generally express the hate/contempt characteristic of weaponized uses of slurs, MI-epithets perpetuate epistemic injustice by (...) portraying sufferers of mental illness as deserving minimal credibility. After outlining the ways in which these epithets can cause harm, I examine available legal and social remedies, and suggest that the best path going forward is to pursue a reclamation project rather than aiming to censure the use of MI-epithets. Aristotle's theory of demonstration, developed in the Posterior Analytics, is not restricted to determining the formal requirements for formulating probative arguments that establish properly the results of scientific investigation. To the probative aspect of demonstration it shall be added its primarily explanatory character, orientated by theses of strong ontological and metaphysical content and involving notions like substance, essence and causation. We shall analyze the relation between those two ranges of Aristotle's philosophy of science and investigate how the formal features of (...) demonstration maintain an affinity with the metaphysical background to which scientific activity is conditioned. The most notable contributions to contemporary philosophy of mind have been written by philosophers of mind for philosophers of mind. Without a good understanding of the historical framework, the technical terminology, the philosophical methodology, and the nature of the philosophical problems themselves, not only do undergraduate students face a difficult challenge when taking a first course in philosophy of mind, but instructors lacking specialized knowledge in this field might be put off from teaching the course. This paper is intended to (...) provide a framework for instructors with little background in this area of philosophy to develop a course in philosophy of mind. This course, aimed at the advanced undergraduate student, provides students with the tools necessary for understanding some of the key readings in contemporary philosophy of mind and offers unique benefits to both majors and non-majors. The course described here focuses on just two of the main problems in philosophy of mind—the mind-body problem and the problem of phenomenal consciousness—and briefly touches on other issues one might address. Finally, several solutions to common challenges that arise in an advanced philosophy course are discussed. (shrink)

A common view in the philosophy of perception holds that states of seeing objects face to face have particular contents. When you see, say, a dog face to face, your visual state represents the particular dog that is in front of you. In this paper, I argue for a related claim about states of seeing objects in conventional photographs. When you see a dog in a photograph, for example, your visual state represents the particular dog that was in front of (...) the camera when the photograph was taken, that is, the photograph's depictum. The argument in this paper proceeds in two steps. In the first step, I discuss states of seeing objects face to face. I argue that such a state represents the particular object whose surface is responsible for the optical information that the visual system uses to construct the state's attributive representational content. In the second step, I apply the result of this discussion to states of seeing objects in photographs. I argue that a state of seeing an object in a photograph has a particular content that represents the object that was in front of the camera when the photograph was taken. (shrink)

In this paper, I argue that Plotinus’s critique of divine deliberation in Ennead 6.7 does not seek to banish teleology altogether from his philosophy of nature. Rather, his critique aims to situate teleology within his own metaphysical system so as to reconcile it with the basic principles governing the intelligible universe. In this sense, Plotinus does not propose that we expunge all reference to notions of utility and benefit from our natural explanations; he merely wishes to render those notions coherent (...) with an ontology in which the intelligible always takes precedence over sensible reality. To this end, Plotinus introduces, first, what I call a vertical teleology, where the different animal species create the necessary conditions for the maintenance of higher forms of intelligible life, such as genera. Second, Plotinus advances what I call a horizontal teleology, where the various animal organs serve to provide a minimal coefficient of noetic content to each species in its respective ontic level. Plotinus thus sketches the outlines of a properly ‘noetic’ teleology in Ennead 6.7. (shrink)

This work is driven by the attempt to criticise Phenomenology with the help of Levinas. Similar to the Frankfurt School, he characterises it as a “vision of essences”. These eidetical essences are, and can never be fully absolute, not only because several movements of Hegelian Dialectics are refuted in submitting knowledge either to the imago of mere immanence, or to normative structures which are postulated as invariant like in certain versions of Neoplatonism, but because they function as an apriori of (...) an eternally unfinished and fragmented Lebenswelt. Maybe it is to harsh to compare Husserl to the neoscholastic readings of Descartes and to the formalist interpretations of Kant. Husserl is well aware of the kinaesthetic foundations of consciousness and, contrary to Heidegger, he even promotes Spinozism in a certain phase of his work which excels his adolescent fervour of Berkeley. Nevertheless, Husserl incorporates a subject-based, “monadic” transcendentalism, that paradoxically leads to the dissolution of subjective identity. Traditional reasoning itself is exfoliated to perfection in Heidegger afterwards. Husserl's halfhearted formalism ignores the materialist theory of the simulacrum by Lucretius. Heideggers philosophy widens this overseen aspect in calling the Eidos an Aussehen in referring to the Presocratics, but it despises any kind of method and finally flees in to poetry, maintaining its fatalist errors which it committed right form the start: this is why it gained the name of pseudo-concreteness. Cursed through a specific anti-sociological tendency caused by an anti-empiricist vision of history, their theories virtually (not conceptually) exclude the influences of society on philosophy: they are the end result of the era of Kulturkampf, in which idealism tried to battle positivism, naturalism and historicism. Husserl even defines this philosophical battle as the very struggle of existence. The formulation of the Eidos becomes performance. Aristotle used Eidos synonymous to genus and species. Hence the amplitudes of these philosophies foster the metaphysical standpoint of race, that got out of hand in the Nazi Era and even later on. The “topic” of blood and soil appears in Husserl's definition of Heimwelt and his Eurocentrism. Phenomenology is in no case to blame for National Socialism, and it has very little to to with its causes. My work simply tries to make the same analogy that Marx had made for Hegel. It tries to describe, how two leading philosophers of the German Bourgeoisie are reproducing the categories of their surrounding society without even really observing it. (shrink)

Termed the 'Made-by-Human Hypothesis,' I challenge the commonly accepted notion that Artificial Intelligence (AI) is exclusively crafted by humans, emphasizing its impediment to progress. I argue that influences beyond human agency significantly shape AI's trajectory. Introducing the 'Hybrid Hypothesis,' I suggest that the creation of AI is multi-sourced; methods such as evolutionary algorithms influencing AI originate from diverse sources and yield varied impacts. I argue that the development of AI models will increasingly adopt a 'Human+' hybrid composition, where human expertise (...) merges with AI's intrinsic mechanisms, which themselves are influenced by non-human sources. The Hybrid Hypothesis posits that the origin of AI extends beyond human influence, prompting a thorough exploration of unresolved issues in the field of artificial intelligence. (shrink)

Recent global efforts of the United States and England to withdraw from international institutions, along with recent challenges to human rights courts from Poland and Hungary, have been described as part of a growing global populist backlash against the liberal international order. Several scholars have even identified the recent threat of mass withdrawal of African states from the International Criminal Court (ICC) as part of this global populist backlash. Are the African challenges to the ICC part of a global populist (...) movement developing in Africa? More fundamentally, how are the African challenges to the ICC examples of populism, if at all? In this paper, I show that, while there is considerable overlap between the strategies used by particular African leaders to challenge the ICC and those typically considered populist, as well as a discernible thin populist ideology to sustain them, there is insufficient evidence of a larger anti-ICC populist movement in Africa. Although Africa is not as united against the ICC as the populist narrative suggests, the recent challenges to the Court from Africa pose a significant challenge to the Court, as the institution is still in the early stages of building its legitimacy. In this article, I contribute to the debate between two philosophical traditions—the Kantian and the Aristotelian—on the requirements of criminal responsibility and the grounds for excuse by taking this debate to a new context: international criminal law. After laying out broadly Kantian and Aristotelian conceptions of criminal responsibility, I defend a quasi-Aristotelian conception, which affords a central role to moral development, and especially to the development of moral perception, for international criminal law. I show than an implication of this view (...) is that persons who are substantially and non-culpably limited in their capacity for ordinary moral perception warrant an excuse for engaging in unlawful conduct. I identify a particular set of conditions that trigger this excuse, and then I systematically examine it as applied to the controversial case of former-child-soldier-turned leader of the Lord’s Resistance Army, Dominic Ongwen, who is currently at trial at the International Criminal Court.
